Legal Services Plan FAQ
 
This list of questions gives you a broad picture of the plan offered through the PersonalPlans program. Although most of the information you need is contained here, it is not a contract.

   
When can I enroll?
  You can enroll:
  • Within 30 days of the date you have met your 90-day waiting period.
  • During the annual open enrollment periods for ADP TotalSource employee benefit plan.
Within 31 days of the following life events:
  • Marriage or Partnership
  • Divorce
  • Legal Separation
  • Birth of a child
  • Adoption
  • Death
  • Change in employment status
  • Loss of dependent status
When you enroll, you are enrolling for the full plan year and must remain in the plan until the next annual enrollment period. If you wish to disenroll from the program after the plan year, you will need to call the Marsh @WorkSolutions call center.

How much does this coverage cost and how do I pay for it?
Your monthly cost is:
  • Regular $20.34

You pay for this coverage through payroll deduction.

Why should I consider this plan?

What information will my employer get if I enroll in this plan?
All services through the legal plan are totally confidential. The only thing your employer will know is that you are enrolled in the plan.

What's covered?
This legal plan gives you and your family access to legal advice and professional legal representation at an affordable price, through a voluntary, after-tax payroll deduction. You can obtain services from attorneys in much the same way as you do from the doctors who participate in your medical plan. Your plan covers the following.

In-Office Legal Services

The in-office attorney network is one of the largest in the industry. Network attorney fees are paid-in-full for most covered legal matters.

Some of the services covered under this plan include:

  • Court adoption proceedings
  • Dissolution of marriage
  • Child support orders
  • Uncontested child custody
  • Will(s) and codicils
  • Estate administration and estate closing
  • Real estate matters
  • Driving privilege protection—without DUI
  • Lawyer office work
  • Document preparation
  • Guardianship/conservatorship
  • Name change proceedings
  • Juvenile court proceedings
  • Consumer protection
  • Prenuptial agreements
  • Property protection
  • IRS audit protection
  • Defense of civil damage claims
  • Administrative hearings
  • Defense of insanity or infirmity proceedings
  • Personal bankruptcy
  • Protection from domestic violence
  • Living trust
  • Reduced contingency fees
If there isn't a network attorney within 30 minutes of you, you'll still receive the full plan benefits on most covered issues - guaranteed. Just call PersonalPlans at 1-800-557-1038. A representative will assist you in finding an attorney and explain how to receive paid-in-full benefits.

Non-Network Attorneys

If there are no network attorneys located within 30 minutes of the plan member's home, ARAG Group will work with the plan member to locate an attorney from whom they may receive full in-network benefits.

Telephone Legal Services

Telephone network attorneys can provide you with quick advice on common legal matters as well as provide follow-up calls and letters on your behalf. This plan covers:
  • Unlimited, toll-free telephone legal advice about personal legal matters
  • Follow-up calls and correspondence
  • Simple document preparation including Powers of Attorney, challenges to denials of credit, promissory notes, affidavits, and bills of sale
  • Specific document review (up to 4 pages in length)
  • Complex will preparation
Identity Theft Services

As a value-added service, this plan offers you important information on identity theft. As a plan member, you have unlimited, toll-free access to Identity Theft Specialists who can answer your questions on how to prevent identity theft and how to recover if you are a victim.

Online Legal Resources

You will have access to:
  • Law Guide—Helps you learn about your legal situation and become a better-informed legal consumer.
  • Document Library—Allows you to create your own legal documents.
  • Attorney Finder—Assists you in finding counsel when you need to see an attorney for non-covered matters.

What attorney can I use?
This plan relies on a network of attorneys. The In-Office Attorney Network is one of the largest in the industry. Network attorney fees are paid-in-full for most covered legal matters.

If there isn't a network attorney within 30 minutes of you, you'll still receive the full plan benefits on most covered issues - guaranteed. Just call PersonalPlans at 1-800-557-1038. A representative will assist you in finding an attorney and explain how to receive paid-in-full benefits.

What's not covered?
The plan does not provide coverage for:
  • Legal services for matters against us, the policyholder, and/or your employer.
  • Legal services arising out of your profession, business interests, investment interests, workers' or unemployment compensation, occupation or relocation required by an employer, patents or copyrights.
  • Legal services for the benefit of a person other than the named insured against the interests of another insured under the same certificate.
  • Costs related to title insurance, title search, title abstracting and any costs other than attorney fees.
  • Legal representations in class actions, interventions, or court appeal proceedings.
  • Legal representation deemed by the providing attorney to be lacking merit or representation that is, in the judgment of the providing attorney, in violation of attorney ethics rules.
  • Legal disputes involving insurance contracts or related to structural damage(s), noise, visual or other intangible hindrances arising out of or affecting real estate property.
  • Legal disputes arising out of inheritance law.
  • Court representation in any court action which is or can be brought in Small Claims Court or in a similar court of limited jurisdiction.
  • Legal services which are eligible to be paid by another party, allowed to be paid by law, involve punitive damages claims or other matters normally handled by contingency fee.
  • Matters which are not expressly listed.
Pre-Existing Conditions

Any legal matter which occurs or is initiated prior to the member's effective date will be considered excluded and no benefits will apply. "Initiated" is defined as the date the infraction occurs or the date a document is filed with the court or the date an attorney is hired.
